Badger State Drone Company Policies

Badger State Drone LLC shall retain copyright ownership of all created works, including but not limited to all images and media in their original and processed formats.  Any duplication or alteration of original images is strictly prohibited {Copyright Law Title 17, Appendix V. Additional Provisions of the Digital Millennium Copyright Act 2005, Section 102} without the written permission of Badger State Drone LLC.  Alterations include, but are not limited to, application of filters, cropping, or modifications of any kind.

Badger State Drone LLC can license the use of media to clients or sell the copyrights to all works. Details regarding licensing and copyrights will be discussed during the drafting of the contractual agreement. 

Client use of the works will be limited to what is specifically listed in the contractual agreement. Any use of the works beyond the scope of the contract and/or without written permission from Badger State Drone LLC will be considered a violation of the contract and/or copyright infringement. 

Badger State Drone LLC reserves the right to use all works for its own marketing and portfolio purposes unless otherwise agreed to in a signed contractual agreement.  

All payment terms are listed in the contractual agreement and require the remaining balance to be paid prior to the final delivery of media. Payments are primarily made through secure electronic invoice and offer many convenient and safe ways to make payments for retainer fees and services. All legal tender is accepted. All prices are subject to change without notice.  Signed contractual agreement prices will remain unchanged.  Returned checks are subject to a returned check fee.   

Badger State Drone LLC does require an initial non-refundable retainer fee to reserve a date of service as well as to confirm our commitment to a project. Once the retainer fee is paid, Badger State Drone LLC shall reserve the date and time agreed upon and not make any other reservations or accept any other clients for said date and time. The retainer fee amount varies based on the size and scope of the project to cover the initial costs of scheduling (for clients to reserve a service date and for Badger State Drone LLC to not accept any other clients on said date) as well as to protect Badger State Drone from liquidated damages. The retainer fee shall then be credited towards the total cost of services upon completion of services. The retainer fee shall be paid in conjunction with the signing of a contractual agreement. Both the retainer fee payment and the signed contract must be received by Badger State Drone LLC for the service date to be reserved and scheduled.  

In the event of cancellations, the retainer fee will not be refunded. If Badger State Drone LLC cancels the contract, the retainer fee will be refunded or applied to a rescheduled date mutually agreed upon by Badger State Drone LLC and the client.  

Any rescheduling due to weather concerns or any flight-prohibiting circumstances will be determined by Badger State Drone LLC. In these situations, there are no additional charges associated to the rescheduling of services. 

Any other rescheduling (except in cases of cancellation by Badger State Drone LLC) will forfeit the retainer fee and a new retainer fee will be due for the rescheduled date along with an updated and signed contractual agreement. 

Badger State Drone LLC understands that sometimes, emergencies happen. In that case, contact us with as much notice as possible and we will try to work with you as much as we can. Badger State Drone LLC reserves all rights in making final rescheduling or refund decisions. 

Badger State Drone LLC operates primarily within the State of Wisconsin, but can operate outside of the state. For projects that require out of state services, please contact us for further inquiry. 

Travel mileage fees will be assessed and charged for required travel to locations beyond a 30 minute drive time (one way) from our office to cover overall travel expenses and time. The shortest route of travel shall be used by Badger State Drone LLC unless special circumstances deem otherwise. If a longer route must be used, Badger State Drone LLC shall reasonably and promptly communicate this with the client. 

Badger State Drone LLC requires that all fees for special licenses, location fees, permission for services, and other expenditures to be the responsibility of the client and these costs will be applied to the total cost of services in the contractual agreement.
